    Initially, a DeKalb Circuit Court jury sided with Dr. Koe and Wills Valley Family Medicine. However, the trial court subsequently granted Ratliff’s motion for a new trial, effectively vacating the jury’s verdict. 

    In explaining this decision, the trial court determined that the defendants had not presented sufficient evidence to support their contributory-negligence defense, which argued that McBride’s failure to attend follow-up appointments had contributed to her death.
