Lawsuit: First grader hit by truck after school lets him walk home alone

“A local parent sued the Enterprise City Schools Board of Education and her son's principal on Monday over her child being able to leave the school without supervision and consequently getting hit by a truck. . . On Aug. 30, the boy left school without his older brother and was struck by a truck on the school's neighboring four-lane highway, according to the lawsuit.
Neither the district's superintendent nor the named principal of Pinedale Elementary school immediately returned request for comment.
The first grader was hit by a truck's grille, where he was trapped and dragged. When the truck stopped, the first grader collapsed, and the truck driver rushed him back to the school, according to the lawsuit.
Treated in an emergency room, the boy was found to have extensive bruising, a concussion and a broken wrist, according to the lawsuit. Since the accident, he is also suffers from fatigue, memory and recall issues, and he is frustrated and fearful. The family's lawyer, Alyssa Baxley, said he now refuses to take the bus and his mom now drives him to and from school.
The defendants allege that the school's principal was "confrontational" with the mom, according to Baxley. Baxley said that the principal said that the district allows kids as young as 4 to walk home, so the first-grader should have been fine.
Baxley explained that the district has two kinds of walkers: those that can walk home alone and those that can walk home with an older sibling. The mom authorized the first-grader to belong to the latter group.
Baxley said the lawsuit aims to change policies including the one that allows young children to walk home alone. Furthermore, she said, the first-grader leaving alone violated their current policy, so they want that to be addressed.
The first-grader has since changed schools, where he is adjusting well, other than difficulties in class he did not have before the accident, Baxley said.”
