    How Alabama Child Custody Actually Works

    Alabama courts decide custody based on one standard: the best interest of the child. That phrase sounds simple. In practice, it's anything but.

    Judges examine the full landscape of a child's life before deciding where they'll live, how time gets divided, and who calls the shots on major decisions. Here's what you need to know:

    • There are two types of custody. Physical custody determines where the child lives. Legal custody determines who makes major decisions about education, healthcare, and religion. Courts can award sole or joint custody for each.
    • Alabama does not automatically favor mothers. The "tender years" doctrine — the old presumption that young children belong with their mother — was abolished in Alabama. Courts evaluate each parent on the merits.
    • Courts weigh a wide range of factors. The child's age and developmental needs, the stability of each parent's home, the strength of the parent-child bond, each parent's willingness to foster the other's relationship with the child, and any history of domestic violence or substance abuse.
